Unfinished fitting out scam: A victim lost HKD 900,000; Consumer Council received 91 complaints in the first 5 months

It is easy to arouse conflicts in home renovation, the Consumer Council received 91 complaints in the first 5 months. The political party which assists the follow-up pointed out that 2 kinds of fitting out traps were commonly seen. The first one was unfinished fitting-out and the delay of completion. The second one was the work was different from the design after project completion and follow-up work was refused. A fitting out company involved in more than 4 unfinished work complaints, involving about HKD 2 millions, including a case in which a victim living in Mid-levels lost HKD 900,000. The customs expressed their concern, and said that they had investigated 10 cases and taken legal actions.
Mr. Tang Ka-piu, the spokesman of the Social Affairs Committee of the Hong Kong Federation of Trade Unions, pointed out that he received many requests for assistance in recent months. It was suspected that an online fitting out platform was involved in scams. Fitting out companies and workers delaying the work was commonly seen, causing delays on the completion of projects and unfinished work; another common trick was disappearance, after the completion, when the owner found that the work was different from the design, the construction workers disappeared. He thought that the related fitting out cases were difficult to chase for compensation, some victims were worried the fitting out companies had their addresses and were afraid of being threatened, so they were fear to speak out though they were angry; some victims did not know the information such as full names of the fitting out companies and workers, the compensations were irrecoverable.
According to the data of Consumer Council, between 2019 and 2020, it received 293 and 244 complaints involving fitting out work separately, and 91 complaints in the first 5 months this year. The customs said from 2019 to now, they started 10 investigations after organizing the reports, 4 of them were convicted, two companies were fined HKD 20,000 and HKD 30,000, a male employee was sentenced to 80 hours' community service, another male employer was fined HKD 8,000. The customs would keep paying attention and enforce the law. Mr. So Ka-lok said, he understood that there were easily two sides to every home renovation. It was difficult for prosecution, but he thought the prosecution number of the customs was quite low.

- Learn about the structure and strength of the fitting out company before choosing it, for example, if the company has related ISO International Certifications, or if the company provides regular training to its employees, the experience and specialty of a designer and the professionalism of the fitting out workers can also be the reference. Besides, normally, the company with related International Certifications has to work according to the ISO standards, and provide professional training to the fitting out workers.
- Don’t choose discreditable companies because of low prices to avoid unnecessary loss.
- When choosing a fitting out company, pay attention to the management culture of the company, and if the company provides various training to its frontline and backend support staff regularly.
- If defects are found, you must request compensation from the company, you can take photos for the compensation later to protect your own rights.
- Specific requests on fitting out, design or construction materials should be listed in the contract clearly.
- Understand the contract terms and performance pledges before construction, enter into a clear and definite agreement, including the construction items and total expenditure, list out the payment method and process, and sign to confirm by mutual consent.
- During the fitting out, additional items should commence upon an agreement of additional items is signed by mutual consent, contents and prices are agreed by both parties.
- It is safer to choose companies which provide interest-free installment, because these companies have passed strict examinations of banks, including the financial status, normally these companies are more reliable. The agreement signed by both parties should include the payment method of the fitting out fee, such as the payment schedule, monthly payment date and payment amount per period, etc.
