Fitting out dispute | Construction concrete fell on the balcony below from the flat above. ‘We spent an hour to clean every night,’ residents of the village house said

Recently, a journalist reported an incident told by a man living in a village house in Hong Kong, he said that during the renovation of the flat above, a large amount of concrete debris fell on his balcony, it looked like a rubbish dump, he spent almost an hour to clean every day, there was water leakage indoors as well, that owner neglect his complaint, he had nothing to do but felt disturbed; some netizens suggested to take legal action.
Some netizens thought that neighbours should avoid falling foul of each other, the best way was to seek out a peaceful solution; some thought that the neighbour was standoffish, taking legal action is the only method, including sending a lawyer's letter for compensation.
Under the Waste Disposal Ordinance, it is prohibited to dump waste in public places or on Government land, or on private premises without the consent of the owner or occupier. Besides, in case of illegal noise disturbance caused by construction, the affected residents can complaint in a right way, in August this year, the person in charge of a fitting out project and a construction worker illegally carried out fitting out works in a residential flat using mechanical equipment on public holidays, causing noise disturbance, they were convicted and fined $10,000 at Kwun Tong Magistrates' Courts for contravening the Noise Control Ordinance.

- When walking at the side of a building, choose to walk under a covered path, to avoid being injured by falling objects.
- If renovation or maintenance is needed, choose contractors registered in Buildings Department for carrying out minor works to ensure safety.
- Understand the structure and strength of the company before making decision, for example, will the company provide regular trainings to employees, the experiences and skills of designers, the professionalism of the construction workers, choose large, reputable and experienced companies. The fitting out companies with ISO certifications and supported by banks to provide free installment service are more reliable.
- A lot of old buildings in Hong Kong are facing risks of lacking maintenance. Hence, management company and owners' corporations should pay more attention to the buildings to avoid accidents.
- Recruit legal and professional buildings professionals or registered contractors in Buildings Department for carrying out minor works, Minor Works Control System has been fully implemented since 31st December, 2010. According to ‘Building (Minor Works) Regulation’, if owners need to carry out the regulated 126 minor works in Minor Works Control System.
