Project dispute of Tsz Shan Monastery, Chun Wo is managed to recover about one hunderd million construction cost from CK Hutchison Holdings Limited.

The dispute involving the development of Tai Po’s Tsz Shan Monastery, which Li Ka Shing, chairman of CK Hutchison Holdings invested 1.7 billion in, reached a conclusion when the judge of the court case returned a verdict that the engineering contractor Chun Wo Building Construction Limited (Chun Wo) and subcontractor Sin Wai Construction Limited (Sin Wai) are both responsible for the delay of the project. Chun Wo can claim from Sin Wo an estimated construction cost of more than 100 million but Chun Wo is also to settle a claim from Sin Wai of around 10 million. The judge mentions in the verdict that during the course of the construction, Chun Wo’s water proofing and drainage works were of substandard quality, causing water leakage and damages to the stone works, which were also of questionable quality. Nonetheless, the pressure put on Chun Wo by Sin Wai to complete the project and the moving in of monks later on caused further delays of the construction.

As can be seen, even a 1.7 billion construction project can be prone to disputes arising from the workmanship of the contractors. By the same token, one must bear the following in mind for home projects to avoid unnecessary troubles:
  1. Before selecting a firm for a home project, get to know the company’s scale and organisational structure, such as whether they provide professional training and support to its employees, their designers’ specialties and their builders’ professional qualifications. Choose a large scale, well known and experienced company as far as possible.
  2. Select a reputable firm and pay attention to whether they have ISO certifications. Make sure that their builders have been trained to ISO standards.
  3. Select a firm which provides free structural warranty. This not only guarantees their build quality but also protects the rights of their customers.
  4. Make certain that the contents of the engineering contract are correct and that each engineering item’s material, agreed completion date and other remarks are clearly listed. In addition, it should also state that any engineering changes raised by the client during the construction period will be separately signed and appended to the contract.
  5. According to the “Building (Minor Works) Regulation”, if any of the listed 126 “minor works” under the “Minor Works Control System” is to be carried out, you must employ legal and suitably qualified professionals or Buildings Department registered “minor works contractors” for the construction, as the “Minor Works Control System” has been fully in force since 31 December, 2010.
